Terms of sale

1. Purpose

These terms of sale apply to every purchase of classes on the English in Action website, by a parent for their child or by an adult for themselves. They are accepted with each order, by ticking the box provided.

3. The classes

• Online English classes by video call: the English in Action method (real-life situations, role play, speaking) or classic English classes.
• Group classes: in a small group, on a weekly slot, 1h15 per session. Individual classes: one-to-one with the teacher, 50 min per session.
• Classes are sold in packs (a number of classes of the same type). A trial class (a group class) is offered once per student.
• Each pack has a validity period, shown when ordering (for instance 6 weeks for 4 classes), counted from the payment; the trial class is valid 3 weeks.
• The student is placed in a group by our teaching team according to their age, level and availability; joining a group may take some time when the chosen slots are full.

4. Order

Classes are bought once logged in, from “My space” (website or app), for a student of the account. The customer chooses a trial class or a pack, checks the summary and the price, accepts these terms and confirms the order. A confirmation email is sent once the payment is confirmed.

5. Prices

Prices are in euros, including VAT. The price of a class depends on its type (EIA or classic), its format (group or individual) and the student's age range on the day of purchase; the price of a pack is the number of classes multiplied by that price. The price that applies is the one shown when ordering; a price change does not alter past orders.

6. Payment and invoice

Payment is made by card (or Apple Pay, Google Pay) on the secure page of our payment provider Stripe; the website keeps no bank details. The classes are credited as soon as the payment is confirmed. An invoice is available in “My space” and linked in the confirmation email.

7. Use of the classes

• Each session held by the student's group (as soon as the teacher joins the video call) uses one class of that group's type and format, whether the student attends or not.
• Cancelling a session: the family, or the student themselves from 15, can cancel a session from “My space” (website or app) no later than 24 hours before it starts; it is then not counted. After that, the session can no longer be cancelled and it is counted, whether the student attends or not.
• Validity: classes are used starting with those that expire first. At the end of a pack's validity period, the classes left are lost and counted as used; they are neither carried over nor refunded.
• When no class of their group's type is left, the student stays in the group but can no longer join the video calls until a new purchase. A session missed for lack of classes is not counted.
• The family is told by email when one class is left, then when none is left.
• Classes are followed with a recent computer, tablet or phone, an internet connection, a camera and a microphone, provided by the customer.

8. Right of withdrawal

A consumer customer has 14 days from their order to withdraw, without giving any reason, by writing to contact@theatalk.com. The refund is made within 14 days, by the payment method used. If the customer asked for the classes to start before the end of this period and sessions were held, the amount of the classes already used remains due.

9. Refunds

Outside the right of withdrawal, a purchase can be refunded as long as none of its classes has been used and its validity period is not over. Classes already used or expired are not refundable. Any full refund comes with a credit note.

10. Liability

We do our best to hold the classes at the planned times. If the teacher cannot attend, they may cancel a session; the students are told by email and no class is used for a session that did not take place. We are not liable for an interruption due to the customer's equipment or connection.

11. Personal data

The data needed for the order is processed in accordance with our privacy policy.

12. Complaints, mediation and governing law
